Manslaughter vs. Murder
Manslaughter is defined as the killing of another human being without premeditation, malice aforethought, or deliberation. Manslaughter is not simply a lesser degree of murder—it is a serious criminal offense all on its own. The main difference lies in the intent. In order for someone to be convicted of murder, there must have been malice aforethought.
It is important to understand there are two different types of manslaughter:
- Voluntary Manslaughter Is The Intentional Killing Of Another With Circumstances That May Make The Crime Less Severe. In Most Cases, Individuals Charged With Manslaughter Are Provoked. If It Can Be Proven The Individual Was Sufficiently Provoked, A Charge Of Murder Could End Up Being Reduced To Manslaughter. Penalties For This Crime Include Fines, Probation, Community Service, And Between 3 To 11 Years In Prison.
- Involuntary Manslaughter Is The Killing Of Another Individual Without Intent. Involuntary Manslaughter Can Be As A Result Of Criminal Negligence Or An Unlawful Act. For Example, A Negligent Driver Who Causes A Fatal Car Accident Could Be Charged With This Crime.
